Obrácení důkazního břemene při odpovědnosti za újmu způsobenou chybou při ošetření a při poučení v německém občanském zákoníku

V tomto textu bude představena právní úprava obsažená v § 630h německého občanského zákoníku (BGB), upravující tzv. ulehčení dokazování v medicínskoprávních sporech. Ustanovení § 630h BGB, které bylo přijato v rámci novelizace BGB prostřednictvím zákona o právech pacientů (Patientenrechtegesetz) ze dne 26.2.2013, v zásadě navazuje na bohatou rozhodovací praxi německých soudů a konsoliduje ji.
Abstract:
This paper introduces the legal provision regarding the so called simplification of burden of proof in medico-legal disputes according to S. 630h of German Civil Code (BGB). The legal provision concerned was enacted via novelisation of the BGB by the Act on Patients´ Rights (Patientenrechtegesetz) of 26th of February 2013. It both follows in principle and consolides the fairly established rules on burden of proof laid down by German courts.
