Abstract
The article deals with the reimbursement of maintenance costs (for a person in a vegetative state) and its relation to compensation for loss of earnings according to the Civil Code, in light of the recent judgment of the Constitutional Court, file reference III. ÚS 39/22, dated July 25, 2023, which critically analyses and disputes its doctrinal correctness. Additionally, the article includes an analysis of German and Austrian law, upon which the Constitutional Court also based its judgment.
