Zamyslenie nad jedným dohovorom a jeho prínosom pre zdravotne postihnuté osoby

Abstract
Abstrakt: Dňa 13. decembra 2006 bol na pôde OSN prijatý Dohovor o právach osôb so zdravotným postihnutím, ktorý pre Slovenskú republiku nadobudol platnosť 25.06.2010 a má povahu medzinárodnej zmluvy majúcej prednosť pred zákonmi a Ústavou SR. Význam tohto Dohovoru spočíva predovšetkým v „zhmotnení“ dlhoročnej iniciatívy zameranej na ochranu práv zdravotne postihnutých osôb na medzinárodnej úrovni, na podklade ktorej je „najväčšej svetovej minorite“ umožnené žiadať rešpektovanie ich ľudských práv. Náš príspevok sa zameriava na analýzu katalógu práv, ktoré majú chrániť osoby so zdravotným postihnutím, presahmi na oblasť poskytovania zdravotnej starostlivosti ako aj jeho dopadom na vnútroštátne politiky štátov, ktoré tento Dohovor transponovali do svojich vnútroštátnych poriadkov. V neposlednom rade je pozornosť venovaná súvisiacej judikatúre Európskeho súdu pre ľudské práva.
Abstract: On 13 December 2006, the UN adopted the Convention on the Rights of Persons with Disabilities, which in the Slovak republic came into force on 25.06.2010 and as an international treaty takes precedence over the laws and constitution. The importance of this Convention lies primarily in the "materialization" long-standing initiative aimed at protecting the rights of disabled persons at the international level, on the basis of which is "the world's largest minority" able to demand respect for their human rights. Our contribution focuses on the analysis of the catalogue of rights which is supposed to protect a person with a disability, overlaps in area of health care and its impact on national policy states that transposed the Convention into their national law systems. Finally, the attention is paid to the related case law of the European Court of Human Rights.
