Vybrané právní aspekty spojené se smluvním charakterem poskytování zdravotních služeb

Abstract
Abstrakt: Nový občanský zákoník zavedl nově typ smlouvy upravující právní režim poskytování péče o zdraví. Nová smluvní úprava je inspirována zejména DCFR a nizozemským občanským zákoníkem. V rámci existence tohoto nového smluvního typu je ovšem nezbytné určit, zda všechny vztahy mezi poskytovateli zdravotní péče a pacienty se řídí ustanoveními tohoto smluvního typu nebo jsou použitelné i smluvní typy odlišné (např. smlouva o dílo). S tímto zařazením pak také úzce souvisí problematika odpovědnosti poskytovatele zdravotních služeb za vady a za škodu.
Abstract:
It is obvious that new civil code provides very far reaching changes for the healthcare providers and their patients. Civil code presents completely new type of contract – treatment contract. This regulation was influenced especially by DCFR and Dutch civil code. But due to historical reasons it is not completely clear if this new type of the contract is applicable without exceptions in all relationships between healthcare providers and patients or there are also other types of contracts which are applicable. The aim of this article is to provide guidelines for this determination of different types of contractual relationship.
This determination of the contracts is very important for establishment of rights and duties of contractual parties, their potential liability and other remedies.
